Stockholm arbitration court names NCER responsible for decision on gas entry point

The Arbitration Institute of the Stockholm Chamber of Commerce has named the issue of the transfer of the gas entry point and the possible application of the principle in the transit contract with Gazprom is in competence of the Ukrainian regulator, CEO of national joint-stock company Naftogaz Ukrainy Andriy Kobolev said at a press conference in Kyiv on Thursday.

"The entry and exit [points] and everything that concerns new energy legislation is the issue of regulation and it is in competence of the NCER [the National Commission for Energy, Housing and Utilities Services Regulation]," he said.

"We are going to deal with the issue of tariff revision. This also concerns the issue of "virtual reverse" route. This all falls under the category of the introduction of Ukraine's energy legislation into the contract. If the negotiation process fails, there are other tools and their choice is great. I would like not to give [details], because this will depend, in part, on the actions of the regulator, which is an independent one. I cannot comment on what steps they will take," Kobolev said.
