Ukraine appeals to ICAO and maritime arbitration over Russia's actions in east and Crimea – Justice Ministry

Ukraine is using quasi-judicial tools to demand that Russia compensate for the losses related to its actions in Crimea and in the east of the country, in particular, it has filed complaints to the international aviation organization and international maritime arbitration, Justice Minister Pavlo Petrenko has said.

"We are now using other tools – quasi-judicial, for example, the ICAO international aviation organization, of which both Ukraine and Russia are members," he told journalists in Kyiv on Tuesday.

He also added: "We recorded 3,360 cases of the violation by Russian companies of our aviation space and are imposing penalties - every day it's about $1 million. As of yesterday it was about UAH 200 million. These amounts were presented to the Russian side, and we filed a complaint."

He said that the complaint demands that the Russian side compensate for these losses.

"The consideration procedure is the following: ICAO establishes the fact of illegal crossing of our airspace and then obliges Russia to compensate for the losses," he said.

Petrenko said that Russia would most likely evade this obligation and then the next step would be the submission of an application to exclude Russia from the ICAO.

"Legal implications are very simple - Russian companies are not allowed to fly over the territory of an ICAO participating state," he said.

The minister added: "We are doing the same thing within seaports. There will be a similar domestic arbitration procedure, and a bill will be presented on our losses for the missed opportunity to use our ports."

"We will raise the issue of excluding Russia from a respective convention so that their ships did not enter the ports, as well as the issue of compensation for our losses," he said.
