Zelenskyy puts into effect NSDC’s decision on liquidation of all medical and social expert commissions starting December 31, 2024
Ukrainian President Volodymyr Zelenskyy has put into effect the decision of the National Security and Defense Council (NSDC) of Ukraine of October 22, 2024 "On combating corruption and other offenses in determining the disability of government officials."
Corresponding decree No. 732/2024 was published on the presidential website.
The Cabinet of Ministers, in particular, has been instructed “together with the Ministry of Health of Ukraine, to prepare a bill within one month, “providing, in particular, for the liquidation of medical and social expert commissions from December 31, 2024.”
In addition, the Prosecutor General’s Office, the Security Service of Ukraine (SBU), the State Bureau of Investigations (SBI), the National Police, and the National Anti-Corruption Bureau (NABU) are recommended to "report within one month on the measures taken to respond to identify, investigate, and combat corruption and other criminal offenses when establishing the disability of government officials."
Based on the results of the work carried out, it is necessary to propose appropriate personnel and organizational solutions.
The Cabinet of Ministers was also instructed to create, together with the Ministry of Health of Ukraine and the State Bureau of Investigations, the Security Service of Ukraine and the National Police, as well as with regional and Kyiv city military administrations, working groups within a week to verify the decisions of the Medical and Social Expertise Commission on establishing disability for officials of the relevant government agencies.
In addition, the Cabinet of Ministers must also prepare a report within three months on the results of the working groups’ review of the validity of such decisions.
In the event that facts of unjustified adoption of these decisions are revealed, it is necessary to initiate their revision if there are grounds for this from law enforcement agencies, as well as other authorized bodies.
The Cabinet of Ministers is also responsible for preparing and submitting, together with the Ministry of Health and the Ministry of Digital Transformation, within two weeks a plan for the digitalization of all stages of the Medical and Social Expertise Commission.
Together with the Pension Fund, the State Bureau of Investigations of the National Police of Ukraine, and the Security Service of Ukraine, it is necessary to conduct an audit of the accrual of disability pension payments to government officials within a week.
In addition, the Cabinet of Ministers has been instructed to prepare a bill together with the Ministry of Social Policy to revise the system and mechanism for calculating pension payments to government officials to ensure fairness in the relevant area.
The Office of the Prosecutor General has been instructed to prepare a bill to regulate the procedure for calculating salaries and pensions for employees of the prosecutor's office of Ukraine, in addition to securing the appropriate social guarantees for persons with disabilities to work in the prosecutor's office; conducting repeated checks of the decisions of the Medical and Social Expertise Commission, on the basis of which prosecutors were determined to be disabled.
The Cabinet of Ministers, together with the State Border Guard Service, must work out within one month "the issue of amending the regulatory legal acts regarding the specifics of crossing the state border of Ukraine by former officials of state bodies who have disabilities, with the list of their documents subject to verification."
The NACP (National Agency on Corruption Prevention) is recommended to submit to the Cabinet of Ministers by December 31, 2024, draft laws on amendments to the Criminal Code and the Civil Procedure Code that would define the chairman and members of the Medical and Social Expertise Commission as subjects of criminal liability for illicit enrichment and defendants in cases of recognizing assets as unjustified.
