Supreme Court upholds CEC appeal on cancellation of registration of MP Onyshchenko as parliamentary candidate for Rada elections
The Supreme Court has granted the Central Election Commission (CEC) appeal against the decision of the Sixth Administrative Court of Kyiv, which ordered the commission to register Oleksandr Onyshchenko as a candidate for deputy, the press service of the Central Election Commission said.
"The decision of the Supreme Court of July 21, 2019 satisfies the appeal of the CEC, which the commission filed on the decision of the Sixth Appeal Administrative Court of July 17, 2019, by which the CEC was obliged to register Onyshchenko as parliamentary candidate in election district No. 93," the message reads.
As noted, the Supreme Court concluded that the circumstances Onyshchenko referred to, namely studying abroad, and which were recognized by the Sixth Appeal Administrative Court as the newly opened, existed at the time of the judicial decision.
In its decision, the Supreme Court found that the provision of an inadequate legal assessment to the established factual circumstances of the case led the Sixth Administrative Appeal Court to an erroneous conclusion.
