British upset over court decision ignoring information about Nasirov's British citizenship – Sytnyk

British officials are upset by the court decision ignoring information confirming the existence of a British passport belonging to suspended Ukrainian Fiscal Service Chief Roman Nasirov, National Anti-corruption Bureau of Ukraine chief Artem Sytnyk has said.

"Our British colleagues presented materials confirming the existence of British passport belonging to Nasirov. NABU and the Specialized Anti-corruption Prosecutor's Office (SAPO) confirmed the materials. Nasirov, on the other hand, said all this was not true and that he did not receive this passport. The court declined to take our conclusions and these documents into consideration. To be honest, this upset our British colleagues," Sytnyk said at a briefing in Kyiv on Tuesday.

The NABU chief said the court ruling has not been appealed and is proof that Ukraine's judiciary can not effectively deal with cases like the Nasirov one and is the reason it is necessary to create a specialized anti-corruption court.

Kholodnytsky, in turn, said in international law the situation can be likened to "the absence in Ukraine of a rule of law when it concerns individuals who can flee abroad." He added that Nasirov said to him, "Sooner or later I will put you behind bars."

As reported, the National Anti-Corruption Bureau of Ukraine suspects Nasirov of committing crimes pursuant to Part 2 of Article 364 of the Criminal Code of Ukraine (misuse of public office leading to serious consequences).

Kyiv's Solomiansky District Court on March 7 remanded Nasirov in custody for 60 days and set bail at UAH 100 million. Ukraine's Specialized Anti-Corruption Prosecutor's Office (SAPO), meanwhile, requested the court set bail at UAH two billion.

On March 16, SAPO said Nasirov and his wife had posted UAH 100 million bail.

On May 30, NABU turned down Nasirov's request to leave Ukraine for medical treatment.

On June 2 Kyiv's Solomiansky District Court turned down a request by Nasirov to change the terms of his pretrial detention.

NABU detectives and SAPO agents filed a motion to recover UAH 100 million bail from Nasirov because he did not turn in his British passport. The court rejected the motion and its decision cannot be appealed.

On June 8 Kyiv's Solomiansky District Court turned down NABU's and SAPO's request to confiscate UAH 100 million in bail posted by Nasirov because he did not turn over his British passport as agreed.
