Supreme Court to challenge judicial amendments to constitution in Constitutional Court soon

A query challenging the constitutionality of certain provisions of the law "On Amendments to the Constitution of Ukraine (Regarding Justice)" will be sent to the Constitutional Court of Ukraine in the coming days, Head of the Supreme Court of Ukraine Yaroslav Romaniuk has said.

"We haven't sent the query yet but the decision has been made. We are still working on its text, and will take into account the comments that were made today by participants of the plenum. I think it's a matter of a day or two, and it will be submitted," Romaniuk told Interfax-Ukraine on Monday.

He added that as soon as the Supreme Court has sent its query to the Constitutional Court, the relevant information will appear on the Supreme Court's website, and its receipt will be reported on the website of the Constitutional Court.

According to Romaniuk, the provisions of the Constitution concerning the entity, which makes a decision to liquidate the court, have been violated. "According to the Constitution, which was in force at the time of adoption of this document, and the Constitution, which is still in effect, until the end of 2017 the prerogative belongs to the president of Ukraine and not to the Verkhovna Rada," he added.

When asked if the Constitutional Court of Ukraine has an opportunity or the right to suspend the amendments to the Constitution regarding justice for the time when the Constitutional Court will be considering the Supreme Court's query, Romaniuk said: "Firstly, we do not appeal against the amendments to the Constitution as such. The amendments to the constitution came into force, and we are not against them. On the contrary we support them. You remember that there were two votings: firstly the law [on amendments to the constitution of Ukraine regarding justice] was passed and then the amendments to the Constitution were adopted. We are against the law, and not the law as a whole, but its final provisions, which lay down the procedure of liquidation of the Supreme Court."
