ECHR takes "Avakov case" for consideration

The European Court of Human Rights (ECHR) has accepted for consideration a statement of Interior Minister of Ukraine Arsen Avakov's son, Oleksandr, about the illegality of his detention by the NABU, his lawyer Oleksandr Lysak has said.

"On June 2, I received documents that the ECHR had accepted the case for consideration. There is still no solution, of course, but we have reasons for optimism, because this year there have been two precedents with a positive decision of the European Court against two citizens of Ukraine - Yevhen Korniychuk and Anatoliy Makarenko," Lysak noted.

The lawyer also told about the main reasons that prompted his client to apply to the ECHR.

"Oleksandr Avakov was detained in his apartment. He did not try to go into hiding from the investigation, so there were no reasons to apply Article 208 of the Criminal Procedure Code, when people are trying to go abroad or there is a reason to believe that they can do it. NABU could easily carry out a search in his apartment - he did not interfere with it. So, we believe in a positive for us decision of the ECHR," Lysak stressed.

The European Court of Human Rights this year has sustained the claims of former Deputy Minister of Justice of Ukraine Yevhen Korniychuk and former head of the Customs Service Anatoliy Makarenko, obliging Ukraine to pay them compensation in the amount of EUR 6,500 and EUR 10,000 respectively. Both plaintiffs sued the ECHR for illegal detention by Ukrainian law enforcement agencies.
