Special order to be in effect with launch of joint forces operation in Donbas – command

A special order will be in effect with the decision of Ukrainian President Petro Poroshenko on the start of the operation of joint forces in the area of Donetsk and Luhansk regions.

The resolution on the special order was handed to Interfax-Ukraine by the Command of the joint headquarters on Friday.

The resolution will take effect on Monday, April 30.

According to the document, this procedure provides the bodies of the security and defense sector, other state agencies of Ukraine with special powers required to implement measures to ensure national security and defense, repulse and deter the armed aggression of the Russian Federation in Donetsk and Lugansk regions.

The zone of security adjacent to the combat area is: Vynohradne, Kurakhove, Ocheretiane, Rozivka, Vovcheyarivka, Bila Hora, Novoaidar, Sadky, Makarivka, Prostiane, along the administrative border of Lugansk and Kharkiv regions, Olhivka, along the administrative border of Donetsk and Kharkiv regions, Znamenivka, along the administrative border of Donetsk and Dnipropetrovsk regions, Komyshuvakha, along the administrative border of Donetsk and Zaporizhia regions, Urzuf, and along the sea coast, Prymorske.

In the security zone, by the decision of the commander of the joint forces, areas of restricted access and restricted areas can be established.

"Persons who are not involved in measures to ensure national security and defense, repulse and deter armed aggression in Donetsk and Lugansk regions, are admitted to the restricted area under a decision of the commander of the joint forces, commanders of operational-tactical groups and relevant commanders, in whose powers are to ensure and comply with the order of staying in the areas of the operation of the joint forces and on sites that are under their protection," the document said.

Admission to the area of prohibited access is given on the basis of established patterns of passes, upon the decision of the commander of the joint forces. The admission of unauthorized persons to this area is prohibited.

The area of combat operations is considered to be the area covered by military operations along the contact line, where the units of the armed forces, other military formations and law enforcement agencies carry out combat missions to prevent the enemy from penetrating into the territory of the state.

The document also establishes the regimes of staying in the security zone on the territory of Donbas for persons not involved in carrying out measures to ensure national security and defense, repelling and deterring the armed aggression of the Russian Federation: "green" (the stay and movement of persons is unlimited, except for the areas of restricted access), "yellow" (stay and movement of persons is carried out with the availability of documents, personal inspection of citizens and things, vehicles is carried out, this regime is established on the borders of isolation and restricted access areas), "red" (stay of persons temporarily restricted, prohibited, citizens and officials are admitted to enter the area only with passes, vehicles and citizens to particular areas of land and facilities are not allowed).

"The respective regimes can be temporarily introduced in certain areas, or in the entire security zone under the decision of the commander of the joint forces," the resolution said.

The grounds for admission to the area of the joint forces operation for persons not involved in measures to ensure national security and defense, repelling and deterring armed aggression of the Russian Federation is: residing in the area of the operation by a person or his first-degree relatives (if there are relevant documents); the burial sites of relatives or family members are located close the area of the operation, the death of close relatives or family members in the area of the operation, the ownership of the real estate that are located in the area of the operation, the need to participate in the peaceful settlement of the conflict, or humanitarian issues in the national interests of Ukraine, the need to fulfill diplomatic or consular functions, including in the activities of international organizations of which Ukraine is a member (only under a petition or consent of the Ministry of Foreign Affairs of Ukraine), and other grounds.

According to the document, servicemen, law enforcement officers, and persons defined in Article 8 of the law on the specific features of the state policy for ensuring state sovereignty of Ukraine in the temporarily occupied territories of Donetsk and Luhansk regions have some special powers.

In particular: they have the right to use, in case of emergency, weapons and special means against persons who have carried out or are carrying out an offense or other actions that impede the fulfillment of the lawful demands of persons involved in the implementation of measures to ensure national security and defense, resist and restrain the armed aggression of the Russian Federation, or related actions with an unauthorized attempt to penetrate the area of implementation of these measures.

The participants of the operation also have the authority to detain and deliver persons to the bodies of the National Police, to check documents of citizens and officials, in case of their absence, to detain them before identification, to inspect things and vehicles, temporarily restrict or prohibit the movement of vehicles and pedestrians on the streets and roads, do not allow vehicles and citizens to enter some sites and facilities, enter residential and other premises, on the territory of enterprises, institutions and organizations, use communication means and vehicles that belong to citizens (by their consent), enterprises, institutions and organizations, except vehicles of diplomatic, consular and other representations of foreign states and international organizations for communication purposes.
