Poroshenko suggests no changes in anti-piracy provisions of vetoed bill on state support of film-making

Ukrainian President Petro Poroshenko has asked lawmakers to improve bill No. 3081-d on state support of film-making in Ukraine, which he earlier vetoed, and to bring it in compliance with requirements of Constitution, the Budget Code and other acts, leaving the provisions concerning copyright piracy without changes.

The president's key criticism of the bill applies to the article which says that the government support of film-making is carried out at the expense of the Ukrainian State Fund for Film-Making Support, and the money for this purpose will be allocated from the general fund of the state budget in the amount no less than 0.2% of the expenditures of the previous year's budget, according to the proposals to the bill.

"Without denying the need for the government support of the film-making industry at the expense of the national budget funds, I believe that in compliance with the procedure laid down by budgetary legislation this money should be sent to the fund which will be in charge of support of arts and culture development in Ukraine," the statement reads.

The report also says funds derived from lotteries cannot go to the Film-Making Support Fund.

Lawmakers are offered to improve the mechanism of provision of state subsidies to refund part of the expenses to film-makers taking into account the principles laid down by the budget and tax laws, and to create a separate law laying down such a mechanism.

Poroshenko suggested removing the article which says that the public procurement procedure does not apply to the cases in which the procured services are provided for making movies, audio-visual productions, distribution, advertising, preservation, restoration and screening of films.

The head of state also suggests removing the article stating that the transfer of funds from government subsidies as a refund of part of expenses spent on making a movie to a foreign entity doesn't require individual licenses for foreign exchange transactions from the National Bank of Ukraine.

As reported, the Verkhovna Rada passed bill No. 3081-d on state support of film-making in Ukraine and fight against copyright piracy, which amends the law on copyright and related rights regarding the protection of copyright or related rights with the use of the Internet. It proposes the procedure for termination of such violations.

It also introduces amendments to the Civil Procedure Code, which envisage that a lawsuit concerning a copyright violation should entail actions which make impossible the access of the Internet users to the objects of intellectual property rights in question.

As reported, a popular online resource ex.ua, one of Ukraine's largest file sharing sources repeatedly accused of distributing pirated films and other objects of intellectual property named bill No. 3081-d as one of the main reasons for taking a decision to cease its operation.
