Naftogaz to challenge switch of Odesa Port-Side Plant to tolling scheme in court

National joint-stock company Naftogaz Ukrainy believes that the switch of its large debtor – state-run Odesa Port-Side Plant – to the tolling scheme is unlawful. The company is ready to challenge the step in court, Naftogaz Board Chairman Andriy Kobolev has said.

"This violates Ukrainian legislation and gas market regulation. We would have to appeal to court against the plant and the gas supplier/leaser/partner in the tolling scheme," he wrote in comments to the post of Head of the State Property Fund (SPF) of Ukraine Ihor Bilous on his Facebook page about the resumption of the operation of the plant using the tolling scheme.

The partner in the launch of the plant – ERU Trading LLC – selected by the fund is ready to discuss these claims of Naftogaz Ukrainy in court, the co-owner of ERU Trading Andriy Favorov wrote. The fund and the plant have not yet presented their position on the issue.
