If Firtash detained in Ukraine FBI could hand his case to Ukrainian law enforcers – interior minister

If Ukrainian businessman Dmytro Firtash is detained on the territory of Ukraine FBI could transfer his case to Ukrainian law enforcement agencies, which will decide on his fate, Interior Minister of Ukraine Arsen Avakov has said.

"He wants to come to Ukraine, as we do not have extradition. We've found a balance jointly with the FBI. Under Article 597 of the Code of Criminal Procedure of Ukraine, if there is an international request, we can detain him for 40 days, if the arrest warrant is issued, according to the UN Convention against Corruption. There could not be extradition, but first we will arrest him, and then the United States, for example, decides to transfer cases to us. We could accept the case and sentence him here, and we could not to do this. There are things that I don't want to announce now. Believe, all our actions, including my public statements [on detaining of Firtash at the Boryspil airport] were aimed at positioning of Ukrainian authorities which are responsible for the situation," Avakov said in an interview with Dzerkalo Tyzhnia weekly published on Saturday.

The minister said that if the businessman has arrived to Ukraine, it would have been arrested at the airport.

He reminded that the Interior Ministry is investigating into two criminal cases directly linked to Firtash.

"Now this also concerns bank Nadra where there is a guarantee worth billions of hryvnias personally signed by him and that does not work… As for Ostchem, we've reached good results. Wem to be more precise Naftogaz Ukrainy, agreed with Firtash and he will return around UAH 4 billion to the state," he said.
