NACP issues order to Klitschko over Kyivzelenbud chief and his candle factory

Ukraine's National Agency on Corruption Prevention (NACP) has decided to issue an order to Kyiv Mayor Vitali Klitschko due to the violation of the requirements of the legislation on ethical conduct, prevention and settlement of conflicts of interest and other violations of the law, NACP reported on its Facebook page on Tuesday.

The order was issued with respect to Mykhailo Nakonechny, director general of the Kyiv municipal association for green building and exploitation of green plantations of the city (Kyivzelenbud).

"Based on the results of violations detected by the NACP's department of control over compliance with the legislation on the conflict of interests and other restrictions on the prevention of corruption, it was established that Kyivzelenbud's director general, being an official of a legal entity of public law, violated the requirements of Part 1, Article 36 of the law of Ukraine on the prevention of corruption. In particular, he did not transfer the enterprises and corporate rights belonging to him – Kyiv Candle Factory Ltd - to the management of another person," the report says.

The agency said that appointed to the post on August 31, 2016, the official was supposed to do this within 30 days after his appointment, but did not do so, thus committing a corruption-related offense.

In order to eliminate the detected violations, the NAPC demanded that an official investigation be conducted with respect to Nakonechny and that the question of bringing him to justice be considered.

The NACP's order is mandatory for execution. For failure to comply with this requirement, the head of a body, enterprise, institution, or organization is liable under Article 188-46 of the Code of Administrative Offenses. The head of the body, enterprise, institution, organization must report to the NACP on the fulfillment of the order within ten working days from the day of its receipt.
