Competition agency denies Ukrzaliznytsia's statement on failure of diesel fuel tender

The statement of Ukrzaliznytsia regarding the failure of a tender to buy diesel fuel due it being blocked by the Antimonopoly Committee of Ukraine is untrue and could be considered to be defamation, the press service of the committee has reported.

The committee said that adheres to the requirements of Ukrainian law. The permanent administrative group of the committee only discusses claims which were submitted to the committee in line with the requirements of the law on state procurement.

"On August 5, 2015, after discussing a claim of Element Nafta LLC against the actions of Ukrzaliznychpostach state enterprise that put forward discriminative requirements in the tender documents to buy diesel fuel (four lots) made the decision, according to which Ukrzaliznychpostach was obliged to remove the discriminative conditions in the documents. Representatives of Ukrzaliznychpostach agreed with the necessity of removing the infringements at a meeting of the group," the committee said.

The committee said that on August 7, a claim filed by Element Nafta was sent to the group. The company informed the committee that Ukrzaliznychpostach set discriminative conditions in other tender documents to buy diesel fuel (three lots). The procedure was suspended under Ukrainian law.

Earlier, Ukrzaliznytsia said that the committee hindered the holding of two tenders to buy diesel fuel for the railway sector via its decisions under a claim of Element Nafta.
