Court confirms unlawfulness of Naftogazvydobuvannia operation being blocked

The appeal court of Kyiv has lifted the arrest of accounts and property of private joint-stock company Naftogazvydobuvannia and revoked a ban on the sale of natural gas and gas condensate by the company, the company's press service has reported.

"This is the second decision over the past month that confirms the unlawfulness of applying these measures towards the largest private gas extracting company in Ukraine," reads the report.

The press service said that the legal economic operation of Naftogazvydobuvannia had been blocked by Pechersky district court of Kyiv under the claims of Public Prosecutor's Office since April 2015. The reason for applying these measures is a criminal case which has lasted for three years and has no relation to the economic operations of the company.

All the decisions of Pechersky district court on the arrest of accounts and property and a ban on sale of gas and gas condensate were revoked by the appeal court of Kyiv.

"We again proved our rightness. The appeal court again established that the decisions of Pechersky district court of Kyiv are made in violation of the requirements of material and procedural laws. There is no relation between the criminal case opened three years ago and the operation of the company. There are no grounds to impose arrests of bans," reads the report, citing Naftogazvydobuvannia Director General Ihor Schurov.

The press service said that the decision of the appeal court is final and obligatory for execution across Ukraine, although the Public Prosecutor's Office continues to try to block the legal operation of Naftogazvydobuvannia. On May 28, representatives of Public Prosecutor's Office, without waiting to hear the end of the company’s counterclaim, filed a similar claim to Pechersky district court of Kyiv asking for it to issue arrests that were previously declared illegal. The claim will be heard on May 29.

Naftogazvydobuvannia sent an address to the Ukrainian president, Cabinet of Ministers of Ukraine, the Ukrainian parliament, the top managers of Public Prosecutor's Office, embassies of countries-partners, and business ombudsman asking for help to stop the pressure on the company.

If the operation of Naftogazvydobuvannia continues to be blocked, the company will have to stop gas production.

"Ukraine only in 2015 could fall short of up to 1 billion cubic meters of gas, which the country would have to import, in particular, from Russia. The loss of taxes by the budgets of various levels could reach UAH 2.2 billion, and over 1,000 people are under threat of losing jobs," the press service said.

Naftogazvydobuvannia said it is preparing claims to international courts to protect its rights and interests.
