Prosecutors suspect officials of forging documents on purchase, sale of Chornomorsky shipyard
The Prosecutor General's Office (PGO) of Ukraine has notified officials of the State Property Fund, as well as PJSC Kherson Shipyard and PJSC Chornomorsky Shipbuilding Yard (Mykolaiv) of the suspicion in forging by prior agreement the documents of the 2007 contract for the sale and purchase of shares of the Chornomorsky Shipbuilding Yard.
According to a statement released by the PGO's media liaisons department on Wednesday, September 27, three State Property Fund officials, as well as the heads of the Kherson and Chornomorsky shipyards, are suspected of committing a crime under Part 2, Article 28 Part 28, Article 366 of the Criminal Code of Ukraine (compilation, issuance of deliberately false official documents by an official, including deliberately false information in the official documents, and other forgery of official documents committed by prior agreement with a group of individuals).
"It was established during the pre-trial investigation that officials of the State Property Fund of Ukraine, PJSC Kherson Shipyard and PJSC Chornomorsky Shipbuilding Yard, knowing that the terms of the contract for the purchase and sale of the shares of the Chornomorsky Shipbuilding Yard in which investment commitments were included, in particular, the creation of new jobs, technical re-equipment and development of shipbuilding facilities for UAH 49 million, were not fulfilled with the aim of creating legal grounds for the alienation of the enterprise's shares to third parties, and in order to avoid the application of penal sanctions to Kherson Shipyard or the termination of the contract due to its non-fulfillment, on June 27, 2012, acting on a preliminary conspiracy, compiled an official document - an act of final inspection in which they included deliberately false information that the investment obligations have been fulfilled," reads the report.
According to the report, the PGO department for investigating crimes committed by criminal organizations is currently investigating criminal proceedings regarding the abuse of office by officials of the State Property Fund, the Industrial Policy Ministry and Kherson Shipyard when introducing amendments, executing and exercising control over the fulfillment of the terms of the contract for the purchase and sale of the Chornomorsky Shipbuilding Yard's shares, which was signed in 2007, under which 90.25% of the shares were purchased by PJSC Kherson Shipyard.
"The pre-trial investigation is currently underway," the report says.
