Sea Port Authority must apply discount when calculating cost of special grain handling service

The business court in Odesa region has satisfied a claim of LeGran.TT law firm and admitted that Ukrainian Sea Port Authority does not have the right not to apply the discount when calculating the cost of the special grain handling service.

The press service of LeGran.TT reported that the company presents the interests of one of the largest stevedoring companies of Odesa port – Olimpex Coupe International Ltd. On December 8, 2016 the court satisfied the claims of LeGran.TT.

The court said that the Sea Port Authority does not have the right to demand the confirmation of the actual capacity of machines and not to apply the 0.7 coefficient on the basis of the designed capacity of machines. The court also satisfied the claim of LeGran.TT to admit the right of Olimpex Coupe International to apply the 0.7 coefficient when the designed capacity of the machines is confirmed at no less than 500 tonnes per hour.

Thus, LeGran.TT proved that Ukrainian Sea Port Authority does not have the right to not provide the discount of 30% to operators who handle grain in bulk at special terminals using the machine with the designed capacity of 500 tonnes per hour and larger.
