ECHR to deliver judgment on Tymoshenko's second complaint in 2014 at earliest, says government commissioner

Government Commissioner for the European Court of Human Rights (ECHR) Nazar Kulchytsky doesn't expect a ruling on the second complaint by Ukraine's former Prime Minister Yulia Tymoshenko to appear before 2014.

Kulchytsky told Interfax-Ukraine on Wednesday that October 23, 2013, is the deadline for the Ukrainian government to submit its observations concerning the complaint. After that, Tymoshenko's defense team is given one month for submitting counter-arguments, which will be then sent to the Ukrainian government to study.

The government then is given from three weeks to a month to submit its additional comments, Kulchytsky said.

"Actually, no less than seven to eight months pass from the moment of notification [of the defendant] to the time of delivering a judgment by the ECHR," the government commissioner said, adding that it is technically impossible to observe the procedure in less time.

Thus, according to Kulchytsky, there is no reason to say that the ruling of the European Court on Tymoshenko's second complaint may be made shortly after the completion of the ECHR's communication with the government of Ukraine.

Earlier on Wednesday, Vlasenko said that the Ukrainian government should complete the communication with the ECHR concerning Tymoshenko's second complaint by October 23 of this year, after which the defense team has time to make its comments. After that, a ruling on the complaint can be expected at any time, he said.

As reported, on July 15, the ECHR started to consider the second complaint by Tymoshenko concerning the criminal case brought against her on charges of abuse of power during the signing of the gas supply agreements with Russia.

The ECHR notified the Ukrainian government about Tymoshenko's second application and asked it to submit its observations concerning the complaint.
