Competition agency demands to collect UAH 172 bln of fine from Gazprom

Ukraine's Antimonopoly Committee demands to collect UAH 172 billion from Russia's Gazprom, including the fine and penalty cost for non-paying the fine in the due time.

An Interfax-Ukraine correspondent has reported that a representative of the Antimonopoly Committee gave the information in Kyiv's business court on Monday.

"The penalty cost of UAH 180.5 billion was accrued for a delay of 140 days. Under Article 56 of the law on protection of economic competition, the penalty cost cannot exceed the fine, and the Antimonopoly Committee filed a claim to collect UAH 85.966 billion of the fine and UAH 85.966 billion of the penalty cost," a representative of the committee said.

The penalty cost is 1.5% of the fine a day.

Gazprom received the decision on March 4. The term for voluntarily payment expired on May 4, 2016.

The court will continue hearing the committee's claim on November 21, 2016.

As reported, the Antimonopoly Committee levied the fine of UAH 85.966 billion (around $3.3 billion) on January 25, 2016, after determining that Gazprom had abused its monopoly position in transiting gas through Ukraine. However, Gazprom argues that the Antimonopoly Committee does not have the authority to regulate transit through Ukraine.

Kyiv's business court on April 13 dismissed the Gazprom's claim challenging the committee's decision.

The decision of Kyiv's appeal court dated May 18, 2016 in the case was left unchanged, and Gazprom's counterclaim filed on May 4 was dismissed.

Gazprom filed a counterclaim on June 7 to Ukraine's higher business court that on July 13 did not satisfy the claim declaring valid the ruling of a lower instance court and the appeal court.
