Companies demand recovery of UAH 2.4 bln AeroSvit debt along with Kolomoisky's claims

The business court of Kyiv region has received claims from several creditors demanding the collection of UAH 2.383 billion from non-operating AeroSvit airline (Kyiv).

According to court rulings published in the state rulings register, the court received a claim from AJ Walter Aviation Limited to collect UAH 97.447 million from the airline. The hearing of the case has been postponed until June 2, 2015.

The court also received a claim from Triton Aviation International dated April 6, 2015 asking that the court admits UAH 178.761 million and UAH 56.125 million of debt from the airline. The claims were satisfied by the court on May 15.

The court received and mainly recognized the claims of Castle 2003-2С worth UAH 57.4 million, BBAM Aircraft Holdings 118 worth UAH 331.8 million, public joint-stock company Ukrsotsbank worth UAH 133.1 million, Castle 2003-1А worth UAH 11.919 million, International Leasing Financial Corporation worth UAH 185.027 million, Aviation Display worth UAH 38.903 million, Castle 2003-2F worth UAH 81.738 million, and Rapex 1 LLC worth UAH 15.362 million.

Enterprise with foreign investment Albion filed the largest claim worth UAH 1.196 billion.

According to a court ruling, Albion's claim concerns a debt under an agreement to supply aviation fuel signed in 2008 between AeroSvit and OJSC Transnational Financial and Industrial Oil Company Ukrtatnafta (under control of Ihor Kolomoisky's Privat Group). The debt under the agreement for the period of January-November 2012 was declared. The truth of the fuel supply was not challenged by the debtor. Fuel was not paid, and in December 2015 Albion and Ukrtatnafta signed an agreement on the purchase of the claim letter agreement.

As reported, businessman Kolomoisky has demanded the collection of a UAH 3 billion debt from AeroSvit at court.

AeroSvit, which was a large Ukrainian airline, initiated its bankruptcy procedure late in December 2012, however, the procedure was cancelled by the court. The company ceased operations and is not currently servicing flights.

Kyiv region's economic court on March 4, 2015 re-launched AeroSvit's bankruptcy case.
