DTEK to appeal to international courts against 50% feed-in tariff reduction

Ukraine's largest private energy company DTEK is preparing lawsuits to be sent to international courts against the decision of the National Commission of Ukraine for Energy and Housing and Utilities Services Regulation (NCER) on reducing feed-in tariffs by 50%, DTEK Director General Maksym Tymchenko has said.

"We are now preparing for the issue of claims to international courts together with our clients, namely banks, export-import agencies that provided finances for this project," he said to journalists during the Adam Smith Global Forum in Kyiv.

Tymchenko didn't rule out that additional claims would be filed by other operators to international courts against this NCER decision.

"Not only we will have such a reaction, but all those who believed and invested in the green energy of this country [may consider legal action]," he said.

According to Tymchenko, DTEK won its case in Ukrainian courts against the decision made by the state regulator to cancel feed-in tariff indexation in August 2014.

"We got a positive decision. Today I hope the regulator will abide by the court decision without enforcement service involvement," Tymchenko mentioned.

He also said that the regulator makes its decisions without consulting with any companies.
