Bank Finance and Credit, UIA continue litigation in courts

The business court of Kyiv has satisfied a claim of Ukraine International Airlines (UIA, Kyiv) against bank Finance and Credit (Kyiv) on the termination of an agreement and collection of UAH 112.406 million, EUR 150,531 and 1.619 Russian rubles and $2.892 million, or around UAH 180 million at the current National Bank of Ukraine (NBU) exchange rate.

According to a post on the website Judicial Authority of Ukraine, the claim is due to the bank carrying out several transactions under the orders of the airline in 2014, although a large number of payments were not finalized by the bank.

"Attempts of receiving the grounded explanations of the non-fulfillment of payment instructions were left without answer. The company was deprived of a chance of using its funds staying on the bank's accounts," reads the report.

The ruling to collect funds from the bank was supported by the economic court of appeals in Kyiv on May 18, 2015.

The bank told Interfax-Ukraine that at present, the counterclaims of the financial institution against UIA have been filed with the courts.

"Taking into account the stable trend of worsening the financial indicators of UIA as a client in the past year and guiding by the interests of its depositors and other clients, the bank asked the top managers of the airline to cut the volume of liabilities to the bank, which was written in the credit agreement. At present, UIA's debt exceeded $35 million. In response, we've received several court claims, the purpose of which is to block our right as the main creditor of UIA to collect the debt," bank spokesperson Natalia Napadovska said.

She said that there is a positive trend in the negotiations of the bank's top managers with UIA, and the sides are looking for mutually beneficial decisions.
