Higher administrative court rules that UAH 1 mln fine imposed on Shell over Kyiv filling station is legal

The higher administrative court of Ukraine has declared the fine of UAH 1 million which was imposed on Invest-Region LLC, the owner of which is Alliance Holding LLC (both based in Kyiv) which operates the Shell filling stations chain in Ukraine, for the unauthorized use of a filling station at 93, Melnykova Street in Kyiv, as valid and legal.

The State Architectural-Construction Inspectorate reported that the court declared its actions in imposing the fine after infringements were revealed in October 2013 as legal.

"After the long court hearing all court instances, including the higher administrative court of Ukraine, declared the actions of the State Architectural-Construction Inspectorate as legal. As of today, the resolution on imposing the fine for infringements in town construction is being executed," reads the report.

The inspectorate said that Invest-Region was fined as authorized works to install underground reservoirs for fuel and to overhaul a building and roof over the fuel stands at the filling station were completed but the facility was not commissioned.
