Higher business court returns case on collecting UAH 37.5 mln from UIA to Boryspil airport to first instance court

The higher business court of Ukraine has satisfied the counterclaim of Boryspil International Airport on the collection of a UAH 37.5 million debt owed by Ukraine International Airlines (UIA, both based in Kyiv) for the ground servicing of aircraft, and sent the case to the economic court of first instance.

The decision is stipulated in a ruling of the higher business court of Ukraine of April 15, 2015.

According to the ruling, in June 2014 the airport filed a claim with the economic court of Kyiv asking it to collect UAH 37.5 million of debt from UIA formed due to the non-payment by the defender under the ground plane servicing agreement, signed under a facilitated procedure for the period from September 26, 2012 to January 31, 2014.

The economic court of Kyiv in its ruling on November 24, 2014, upheld by the business court of appeals of Kyiv on February 3, 2015, did not satisfy the claim of the airport.
