Kagalovsky says he owns TVi channel, power of attorney on transfer of shares in company to Altman is fake

Businessman Konstantin Kagalovsky has said that his Wilcox Ventures Ltd. is the owner of Media Info LLC, which holds a 100% stake in TeleRadioSvit television and radio broadcasting company (the TVi television channel).

"Wilcox Company is the owner of 99% of the structure, so I'm the owner," he said at a press conference at Interfax-Ukraine on Thursday.

Kagalovsky said that Wilcox Ventures Ltd. has not issued any power of attorney on the transmission of a share in Media Info LLC to Balmore Invest Limited, which earlier was claimed by the beneficiary of the latter, U.S. businessman Oleksandr Altman.

"There was no power of attorney, and my hypothesis is that it was fabricated," he said.

Kagalovsky also said that there was no any agreement between him and Altman on the TVi channel.

"Altman has never had any relation to the channel," he said.

The lawyer of the director of Wilcox Ventures Ltd Nikia Ortodocsia, Andreas Sofocleos, said on behalf of her that she did not sign the power of attorney for Altman on the transmission of shares in Media Info LLC, and the power of attorney has her previous last name.

"I'm empowered from Nikia Ortodocsia, who has this last name for the past 18 months, but Vasiliu, as Altman said, to tell you that she did not register any power of attorney on behalf of Wilcox company to the name of Altman," he said.

The lawyer said that Ortodocsia proposes to Altman to agree to the examination of the authenticity of the document.

"He has never showed it to anyone, and no state agency has this document. If Mr. Altman needs her personal presence, she tomorrow can fly to Kyiv and show her passport and demand to return the power of attorney to her, so that she can see how she has signed it," Sofocleos said.

The lawyer also said that Wilcox Ventures Ltd. plans to carry out various court actions both in Ukraine and other countries to prove that the power of attorney was not presented to Altman.

In addition, Kagalovsky said that he did not plan to sell TVi channel to anyone and did not hold talks on the issue. He said that he has never met Ukrainian businessman Valeriy Khoroshkovsky and did not hold such talks with him.

A journalist of the television channel, Natalia Katerynchuk, who was replaced on the post of director general of TVi channel by Artem Shevchenko on April 23, 2013, said that in the present situation the main issue is the further operation of the channel in the previous format.

"The thing who is director general is not the key issue. For me the issue is not that I want to be director. I'm not protecting my own ambitions. I know that when a company is seized it's a bad sign. The largest problem is that the possibility to operate the channel. I personally do not believe that these people have good intentions," she said.

According to information in the single state register, London-based Balmore Invest Limited as of April 19, 2013 held a 95% stake in Media Info LLC, which holds a 100% stake in TeleRadioSvit television and radio broadcasting company LLC.

The share of Wilcox Ventures Ltd. (British Virgin Islands) is 5%, although recently the company held a 99% stake in Media Infor, and 1% belonged to its director Oleh Radchenko.

The charter capital of Media Info LLC remained unchanged at UAH 1,000.
