Milkiland owner to contest in court NBU order on establishing persons affiliated with bank

The Ukrainian businessman, the owner of Milkiland Group, Anatoliy Yurkevych, has filed a lawsuit against the National Bank of Ukraine (NBU) regarding the illegality of one of the signs for identification of individuals or legal entities affiliated with the bank.

The contested second paragraph of the seventh subpoint of the second point of the third chapter of the regulation on establishment of persons affiliated with the bank, approved by NBU resolution No. 315 of May 12, 2015, gives grounds to establish the existence of such a connection if there is "acceptance from the debtor/counterparty less enforcement of obligations or lower quality enforcement compared to other customers."

Kyiv's District Administrative Court by the ruling dated July 4 launched proceedings on the plaintiff's application. The first trial is scheduled for August 1, 2018.

Earlier, in April 2016, Milkiland-Ukraine subsidiary and its controller applied to Kyiv's District Administrative Court with a claim against the NBU and the Individuals' Deposit Guarantee Fund demanding to recognize unlawful the actions of the fund's authorized person for determination of the plaintiffs as the affiliated and ultimate participants in PJSC Ukrainian Professional Bank (UPB).
