Ukrainian Prosecutor General's Office (PGO) has completed a pretrial investigation into actions of three heads of divisions of the State Property Fund (SPF) of Ukraine and directors general of public joint-stock company Chornomorsky Shipbuilding Yard (Mykolaiv) and public joint-stock company Kherson Shipyard, who are suspected of forgery of documents for the sale and purchase agreement signed in 2007 to sell shares in state-owned Chornomorsky Shipbuilding Yard.

Spokeswoman for the PGO Larysa Sarhan wrote on her Facebook page on Tuesday that during the pretrial investigation it was established that the above-mentioned officials after conducting an inspection, studying all the required documents and knowing for sure that the provisions of the privatization agreement were not implemented, placed untrue information that the buyer implemented the agreement conditions in full amount. This was done to create artificial grounds for allowing Kherson Shipyard to manage the stake of shares without accord of the SPF and not to impose a fine or annul the agreement.

"On January 22, the bill of indictment was sent to court," Sarhan said.

As reported, the office of the PGO investigating crimes committed by criminal groups, investigated the abuse of office by officials of the SPF, the Ministry of Industrial Policy of Ukraine, PJSC Kherson Shipyard when executing control over the fulfillment of the terms of the purchase agreement concluded in 2007 on the sale of the shares of state-owned Chornomorsky Shipbuilding Yard, according to which 90.25% of shares of the shipyard were acquired by Kherson Shipyard.

On September 27, 2017, the PGO notified the three officials of the SPF, as well as the heads of the Kherson Shipyard and the Chornomorsky Shipbuilding Yard, that they are suspected of committing a crime under Part 2 of Article 28, Part 1 of Article 366 of the Criminal Code of Ukraine (forgery in office by a group of persons).

Chornomorsky Shipbuilding Yard and Kherson Shipyard are part of SMG of Smart-Holding belonged to businessman Vadim Novinsky. Chornomorsky Shipbuilding Yard has been in the process of bankruptcy since 2014.
