Economy ministry, Group DF win litigation with Russia's EuroChem over antidumping on ammonia nitrate market

The Economic Development and Trade Ministry of Ukraine, the Interagency Commission for International Trade of Ukraine and the enterprises of Group DF which belong to Dmytro Firtash have won a two-year lawsuit against Russia's EuroChem regarding antidumping measures on the Ukrainian ammonia nitrate market, the press service of Group DF has reported.

"Our legal service received the final decision of the court on the antidumping case… All Ukrainian courts rejected EuroChem's claims when the company tried to revoke imports duties on ammonia nitrate," reads the report.

The press service published the ruling of the Supreme Court of Ukraine of April 21, 2015. The court did not satisfy the claims of EuroChem.

"The unique nature of the proceedings is that the Interagency Commission for International Trade used Ukrainian law and recent practice of WTO on hearing similar investigations which foresees the adjustment of the production cost of the imported goods if the data presented in accounting documents does not reflect the market price of the goods. Ukrainian law has these provisions, although the practice of their application was first used in the proceedings concerning ammonia nitrate by the Economic Development and Trade Ministry," Director for Compliance at Group DF Ihor Holchenko said.
