Public organization to sue Google on personal data protection

A public organization, the Ukrainian Association of Personal Data Protection (UAPDP), is to bring an action against Google on personal data protection, Chairman of the State Service for the Protection of Personal Data Oleksiy Mervinsky said at the press conference in Kyiv on Tuesday.

"The Ukrainian Association of Personal Data Protection is to submit a suit to the headquarters in California if the Google Company. The public organization can do this," he added.

According to Mervinsky, according to the present law, the State Service for the Protection of Personal Data checks the protection of personal data under two criteria: openness and transparency, while the corresponding agencies of the EU have an opportunity to check it under eight criteria.

"We're checking not according to the eight criteria that act in the EU, but under two: openness and transparency. It means that a company that processes our personal data has to report to us about this. But the way it does it, the other six criteria, in particular on protection technologies and mechanisms, are not checked by us," he added.

As the chairman said, Ukraine has a sufficient legal framework to ensure personal data protection. In particular, the legislation foresees not only the duties of organizations that process personal data, but the rights of the citizens.

"The law on personal data protection provides definite rights. None of the laws could afford this, they [the laws] only mentioned the duties of those who process personal data. Now there are 13 such rights," he said.

UAPDP board member Oleksandr Mykytiuk reported that the action against Google will be submitted after receiving information from the State Service for the Protection of Personal Data via an inquiry by the UAPDP on the results of a study of personal data protection.
