Poroshenko enacts two bills on donation telecom messages

Ukrainian President Petro Poroshenko has enacted two bills on donation telecom messages passed by Ukraine's Verkhovna Rada on October 6, 2016, according to a posting on the official website of the Ukrainian president.

Law No. 1664-VIII amending some Ukrainian laws on the creation of favorable conditions for introduction of donation telecom messages introduces the notion "donation telecom messages" and the collection of donations by telecom operators among subscribers if the operators sign a contract with the selected non-profit-making organization.

The law amends the law on the fee for mandatory pension insurance, the law on payment systems and money transfer in Ukraine, the law on financial services and regulation of the financial service markets, the law on telecommunications and the law on charitable activities and philanthropic organizations.

Law No. 1665-VIII amending the Tax Code of Ukraine on the creation of favorable conditions for introduction of donation telecom messages is intended to create favorable conditions for developing charitable activities via telecom messaging.

The document exempts the donation telecom messages from paying VAT (new clause of Article 197 of the Tax Code of Ukraine), and the telecom operators have the right to cut tax liabilities by the sum of VAT (expansion of part 2 of Article 192 of the Tax Code of Ukraine).
