FFU to monitor fulfillment of Lausanne court ruling on Metalist and Karpaty

The Football Federation of Ukraine (FFU) will monitor the fulfillment of the ruling issued by the Court of Arbitration for Sport in Lausanne in the case on a fixed match played between Metalist Kharkiv and Karpaty Lviv in 2008.

"The Football Federation of Ukraine respects the decision of the Court of Arbitration for Sport in Lausanne, and, in accordance with its charter, it will take all of the necessary measures to oversee its fulfillment," the FFU's press service reported on Tuesday.

The federation said that the court had set the period until August 9, 2013, during which the parties to the case can go to court with inquiries about the possibility of leaving confidential information contained in the full text of the decision.

"If the court of arbitration does not get such inquiries within the specified period, the full text of the decision can be made public after August 9, 2013," the FFU said.

As reported, on August 2, the Court of Arbitration for Sport in Lausanne decided to deprive Metalist of bronze medals for the 2007/2008 season. However, Metalist and Karpaty were not deprived of nine points in the 2011/2012 season, therefore the standings in the Ukrainian Premier League remain unchanged.

The court also ruled to ban footballers Serhiy Pshenychnykh, Mykola Ischenko, Vasyl Kobin, Volodymyr Fedoriv, and Maciej Nalepa from playing football professionally for three years, with an additional probation of two years. Each of the abovementioned footballers was fined $10,000.

The court also banned FC Metalist Sports Director Yevhen Krasnikov from carrying out any football-related activity for five years, and imposed a fine of $10,000.

At the same time, the management of FC Karpaty, represented by Petro Dyminsky and Ihor Dedyshyn, were given conditional sanctions in the form of bans on carrying out any football-related activities for one year and six months respectively, which were suspended for probationary periods of one year. The court also fined Dyminsky $5,000 and Dedyshyn $2,500.

The court also ruled to set aside the sanction issued by the FFU against FC Karpaty Director General Oleksandr Yefremov.

The verdict of the Court of Arbitration for Sport reads that the appeals of Metalist and Karpaty were partially upheld.

In November 2010, FC Metalist appealed to the court in Lausanne against a decision of the FFU Appeals Committee to deprive Metalist of the bronze medal for the 2007/2008 sporting season of the Ukrainian Football Championship and of nine points in the standings of the 2011/2012 sporting season of the Ukrainian Football Championship.

FC Karpaty also appealed against the decision of the FFU Appeals Committee to deprive it of nine points in the 2011/2012 standings.

On October 19, 2010, the FFU Appeals Committee upheld the verdict of the disciplinary committee of the FFU dated August 2010 to declare the Metalist vs. Karpaty match on April 19, 2008 a fixed match. Metalist defeated Karpaty 4-0 in that match.
