Development of corporate codes for personal data protection will be obligatory, says lawyer

Kyiv, December 4 (Interfax-Ukraine) - The changes made to the law on personal data protection require the obligatory development of corporate codes for personal databases, lawyer of JSC Volkov and Partners Marianna Bek has said at a press conference at Interfax-Ukraine.

"The service [the State Service for Personal Data Protection] is actively cooperating with the trade unions in the context of the development of corporate codes for personal data protection, and is doing this on a voluntary basis, trying to help adapt the law and apply it in practice. The bill includes amendments supporting the obligatory development such codes, in agreement with the service," said Bek.

At the same time, she said there are several ways to avoid this requirement.

"A company that does not consider it necessary to adopt a certain code, can just adopt specific provisions regarding personal data protection in its corporate code. Another option is the adoption of a provision on personal data protection for a particular company. This can be a provision for a structural subdivision, which is responsible for personal data processing within the company," he said.
