Mobilization bill proposes temporary seizure of funds of persons evading military duty

The new bill on mobilization, which was submitted to the Cabinet of Ministers of Ukraine to the Verkhovna Rada on January 30, provides for the Territorial Recruitment and Social Support Centers to apply to courts for imposing temporary restrictions on traveling abroad and driving a vehicle as well as seizing the funds of a citizen evading military duty.

According to the bill, if during mobilization a person liable for military service or a reservist does not appear on a summons to the territorial recruitment center, and at the same time there is no possibility for the National Police to carry out administrative detention and bring the person liable for military service or a reservist to the territorial recruitment center within 25 days, then the head of the territorial recruitment center, within five days, will send to the citizen a notification in electronic form (if the person has the electronic account of a conscript, a person liable for military service or a reservist) or in paper form by mail with a demand to fulfill military duty.

If a citizen voluntarily, within ten calendar days from the date of delivery of the notification, has not fulfilled the duty specified therein or has not appeared at the relevant territorial recruitment center (a foreign diplomatic institution of Ukraine, if the citizen is abroad), the territorial recruitment will appeal to court for imposing temporary restrictions on such citizen's right to travel outside of Ukraine, drive a vehicle as well as seizing funds held in bank accounts or at other financial institutions or electronic money. The bill stipulates that the restrictions will be lifted after the obligations required by the conscript or reservist are fulfilled.

As reported, government bill No. 10449 on amendments to certain laws relating to certain issues of military service, mobilization and military registration was registered in the Verkhovna Rada on January 30.
