Nasirov's defense asks Poroshenko to take measures to ensure lawyer's secrecy

KYIV. May 21 (Interfax-Ukraine) - Lawyers of ex-head of the State Fiscal Service (SFS) of Ukraine Roman Nasirov are appealing to President of Ukraine Petro Poroshenko with a request to take measures to protect lawyers' constitutional guarantees in connection with violations of lawyer's secrecy by agents of the National Anti-corruption Bureau of Ukraine (NABU).

Lawyer Liubomyr Drozdovsky said at a press conference at Interfax-Ukraine on Monday, May 21, that from August 3 to September 20, 2017, audio and video of confidential communication between Nasirov and his lawyers were unlawfully recorded inside NABU's premises, and later NABU agents tried to use the recordings as evidence for the prosecution in court.

After that, the lawyer said, the defense informed the Prosecutor General about violations of lawyer's secrecy by NABU's agents, which is a crime. According to Drozdovsky, no criminal proceedings were opened, after which the defense appealed in court, which, in turn, ordered the Prosecutor General's Office to begin an investigation. "However, the criminal investigation was closed by a decision of a NABU detective on April 19, 2018, and no investigation had been conducted," the lawyer said.

On May 22, Kyiv's Solomiansky District Court will consider the lawyers' claim against the closure of the criminal proceedings, Drozdovsky said.

In his words, the lawyers sent an open letter to the President of Ukraine with a request to protect the constitutional status of advocateship.

"We are compelled to ask you ... as a guarantor of the Constitution of Ukraine, human and civil rights and freedoms, with a request to take all necessary measures without delay to protect the constitutional status of advocateship as an independent institution of providing professional legal assistance in Ukraine, including initiatives to introduce appropriate amendments to the current legislation of Ukraine, which would ensure the fullest possible constitutional guarantees of advocateship in Ukraine," the lawyer quoted the letter addressing Poroshenko.
