Lawyer: Metalist to continue playing in Champions League if Swiss court suspends UEFA decision

Metalist Kharkiv will continue performing in the UEFA Champions League and play in the play-off round against Germany's Schalke if the Court of Arbitration for Sport (CAS) in Lausanne suspends the decision of the UEFA Appeals Body disqualifying the Ukrainian club from European competitions for the 2013/2014 season, the club's representative in CAS, Head of Sports Law at the Egorov, Puginsky, Afanasiev and Partners Law Firm Markiyan Kliuchkovsky, has said.

"If the court in Lausanne suspends UEFA's decision, Metalist will play Schalke. There can be no other options here," he told Interfax-Ukraine on Wednesday.

He noted that the court could accept Metalist's appeal for consideration and suspend UEFA's decision at any time.

"Maybe today, maybe tomorrow or the day after tomorrow. We expect that this decision will be accepted soon. CAS currently has the cases of two Turkish clubs Fenerbahce and Besiktas. UEFA decisions on them were suspended, and these clubs are quite successfully performing in the qualifying round of European competitions and continue to participate in them," Kliuchkovsky said.

As reported, on August 14, the UEFA Appeals Body announced its decision to disqualify Metalist Kharkiv from UEFA competitions for the 2013/2014 season following the conclusion of disciplinary proceedings against the Ukrainian club.

On August 2, the Court of Arbitration for Sport in Lausanne decided to deprive Metalist of bronze medals for the 2007/2008 season for the alleged fixing of a match played between Metalist and Karpaty Lviv in 2008. However, Metalist and Karpaty were not deprived of nine points in the 2011/2012 season, therefore the standings in the Ukrainian Premier League remain unchanged.

On August 6, UEFA initiated disciplinary proceedings against Metalist under Articles 2.04g, 2.05 and 2.10 of the Regulations of the UEFA Champions League, regarding the admission criteria for participation in UEFA competitions.

On August 7, Metalist Kharkiv won through to the Champions League playoffs by beating Greece's PAOK 2-0 on aggregate (2-0 away and 0-0 at tome).

On August 12, Metalist filed an appeal with the Federal Supreme Court of Switzerland against the CAS ruling.
