Criticism of new Criminal Procedure Code has no grounds, says Portnov

Speculation about the new Criminal Procedure Code of Ukraine has no grounds and is aimed only at disturbing the public, an adviser to the Ukrainian president and the head of the main department for the judiciary at the presidential administration, Andriy Portnov, has said.

"The new Criminal Procedure Code has been introduced successfully. The only thing that creates some misunderstandings today is speculation about citizens' rights. For instance, there are [rumors that] searches at citizens' apartments can be held without court's permission. This is not true. Rumors that people should always have passports with them are also not true. Rumors that one can enter someone's house without a court's permission and that anonymous statements will be taken into account are also not true," the official said in an exclusive interview with Interfax-Ukraine.

According to Portnov, all these rumors about the new Criminal Procedure Code are false.

In particular, the official rejected some media reports saying that investigatory agencies allegedly may start investigations based on anonymous statements.

"This is not true. No anonymous statements will be taken into account. We are not living in 1937," he said.

According to Portnov, practice will show that the new Criminal Procedure Code is one of the best documents in the legal system.

The new Criminal Procedure Code took effect on November 20, 2012.
