Court refuses to prolong retrial restriction against ex-president of Tax Service University Melvyk

The Pechersky district court of Kyiv has rejected a claim of Prosecutor General's Office in Kyiv region to prolong the personal liability imposed on the former president of the National University of Tax Service of Ukraine Petro Melnyk, according to a court ruling of October 9, 2015.

"The ruling cannot be appealed and it takes effect and it is to be executed from the moment of its announcement," reads the document.

According to Part 3 of Article 115 of the Procedural Code of Ukraine, if the term is set in days, it expires within 24 hours of the last day of the term.

According to a ruling of the Pechersky district court of Kyiv of September 8, 2015, personal liability was imposed on Melnyk. On October 8, the prosecution filed an application asking for the prolongation of the personal liability against the defendant.

Melnyk's lawyer Ihor Cherezov wrote on his Facebook on Tuesday that the measure to place him under house arrest under a court ruling of October 1, 2015 was prolonged until December 1, 2015.

"House arrest for Melnyk was prolonged," Cherezov wrote.

As reported, Melnyk was detained on July 27, 2013 on suspicion of demanding bribes from two Ukrainian citizens worth UAH 40,000 and UAH 80,000 to secure their relatives' a place at the university.

Kyiv's Pechersky district court on August 1, 2013, ruled to detain Melnyk on suspicion of bribery and placed him under house arrest. Melnyk was banned from leaving his house unless he needed medical treatment.

On August 7, 2013 Melnyk was ordered to wear an electronic tag, becoming the first former senior official in Kyiv region to wear such a device.

However, he escaped on August 9, having removed the tag.

On August 14, he was put on an international wanted list.

On April 1, 2014, Ukrainian Interior Minister Arsen Avakov wrote on his Facebook page that police had detained Melnyk upon his arrival in Ukraine from London.

On April 2, Kyiv's Pechersky District Court prolonged Melnyk's detention until May 30, 2014, with the possibility of bail. On June 24, the Interior Ministry's press service reported that Melnyk's case was sent to court.
