Court overturns AMC decision recognizing Zeonbud as a monopoly
The Kyiv District Administrative Court has overturned the decision of the Antimonopoly Committee of Ukraine (AMC) which recognized Zeonbud LLC as a monopoly in the telecommunications services market for broadcasting TV programs in a digital format (DVB-T2 (MPEG-4), according to a court ruling dated March 18.
Zeonbud filed a lawsuit against the AMC, in which it said the AMC's decision was made without observing the requirements on defining the monopoly position of business entities, when determining the trade and territorial boundaries of the market, and certain barriers to entering the market. In addition, the plaintiff said the committee, when studying the market, used a limited number of sources.
The court fully satisfied Zeonbud's lawsuit and revoked the AMC order on recognizing the provider as a monopoly.
As reported, the Antimonopoly Committee by its decision of December 23, 2014 recognized Zeonbud as a monopoly in the telecommunications market for distributing TV programs in a digital format (DVB-T2). In January 2015, the agency opened a case against the provider over alleged abuse of monopoly.
