PRESS RELEASE: Former management of shopping mall “Ukraina” continues to hold on to its premises by force
Kyiv, December 20, 2011. Today the acting director of the shopping mall "Ukraina" has made a decision to turn to the law enforcement authorities with respect to the unlawful actions of the dismissed management and actions of the security company hired by this management, which continues to hold on to the administrative premises of the mall by force. The decision was taken after another attempt of the acting director of "Ukraina" Rostislav Levinzon to enter the offices of the mall. The attempt was made after the state registrar of the Shevchenkivsky district has finally registered Levinzon as the acting director of the company. The procedure of the registering of the new management, appointed by the decision of the general meeting of shareholders, has thus been completed. "The situation is paradoxical: I am denied entry to the mall on the basis of the order by Larysa Yanez Puga, whose dismissal from the office of the director of the company has already been registered in the unified state registry of companies and private entrepreneurs. Moreover, for Roman Kravets, the director of the security firm "Ukraine. Business. Security," whose employees are denying us entry to the office premises of the mall, such an order is more important, than the decision of the general shareholder's meeting and the record in the relevant state registry. This is a bright example of how the law of aggressive force is used against our force of law," stated the acting director of the shopping mall "Ukraina" Rostislav Levinzon. The obstruction of the efforts of the newly appointed acting director to enter the premises of the mall has already lasted over a month. The extraordinary general meeting of the shareholders of the shopping mall "Ukraina", during which the director of the company Larysa Yanez Puga was dismissed from her office, and Rostislav Levinzon was appointed to the position of the acting director, took place as long ago as October 7, 2011. The meeting had been called at the request of the majority shareholder – the Swedish company Quinn Holdings Sweden AB, which owns 92.7515% of the shares of the company. On December 15, 2011 the information about Rostislav Levinzon has been recorded in the unified state registry of companies and private entrepreneurs. "Although I was denied entry to the offices of the mall, we are avoiding actions which could lead to conflict. Today I have submitted an application to the police today concerning the obstruction of my efforts to carry out my work. With the view to facilitating dialogue with the mall’s staff and leaseholders, I am initiating the organization of the relevant meeting, during which I plan to announce the priority steps aimed at ensuring the stability of the work of the company. To date, I have already arranged the security of the mall, which is provided by the same company, which provided these services to the mall before, until two months ago its contract had been unexpectedly terminated by Larysa Yanez Puga," said Levinzon. Commenting on the situation the representative of the Quinn Holdings Sweden AB noted: "Today we have witnessed how cynically some can disregard the law. We are extremely incensed by the fact that the dismissed management of the Mall is trying to retain its grip on the company by force. We hope that a legal solution will be found in this situation and that the resistance of the former management of the mall will not damage the company".
