PRESS-Release Ferrero Group: Encouraging decision by the Supreme Court of Ukraine for the protection of the intellectual property rights in Ukraine

Kyiv, January 26, 2010 - Today the Supreme Court of Ukraine accepted Ferrero’s claims and sent en unfavorable case back for additional legal review.

Ferrero is pleased to announce that today the Supreme Court of Ukraine has eliminated earlier negative decisions to cancel the Raffaello trademark registration, which would have seriously jeopardized the defense of Ferrero’s intellectual property rights in Ukraine.

The case will be sent back to the Kyiv Economic Court where Ferrero once again will battle to stop the unfair usage of its Raffaello trademark.

Mikhail Doubinsky, Managing Partner of Patent and Law Agency "Doubinsky and Osharova" says:

"Without any doubts this case will be studied and discussed by specialists in intellectual property. As soon as we get the complete text of the Supreme Court decision we will deeply analyze it. But we already know that based on the fact that the legal protection of Raffaello trade mark has been re-established it becomes possible to stop any attempt of Raffaello trademark infringements".
