Eximagrokom: First Ukrainian International Bank is trying to sell assets it does not own to international agricultural holdings

Kyiv, September 7, 2015. Despite the start of the negotiations process between Eximagrokom LLC and First Ukrainian International Bank, or PUMB as it is better known by its Ukrainian acronym, concerning the loan dispute settlement, the bank continues to put pressure on the agricultural enterprise by filing new claims to the Economic Court of Dnipropetrovsk region. Moreover, Eximagrokom’s management reports that PUMB dishonestly offers recognized American and Swiss agricultural and commodity trading companies to buy an oil extraction plant in Chuhuyiv, owned by Eximagrokom. According to the head of Eximagrokom’s legal department Eduard Danilov, in addition to the forged co-sign contract, PUMB retroactively defined the collateral of property rights agreement with Modern Business LLC, the Dnipropetrovsk based bogus co-signor. Thus, as the lawyer suspects, with the help of ‘loyal’ Dnipropetrovsk judges, including Gennadiy Manko, the bank will be able to obtain the corporate rights to Eximagrokom’s assets. It should be noted that the bank forged contracts with a third party in order to transfer the jurisdiction from the Kyiv Economic Court to Dnipropetrovsk. “It seems that the bank has no doubts about the outcome of the trial and is already trying to conspire with international agricultural and commodity trading holdings as to the sale of the assets, which do not belong to them”, said Eximagrokom’s director Serhiy Holub. As previously reported, based on the loan of UAH 36 million, received by Eximagrokom in 2014 from PUMB, the bank is trying to seize the company's plant in Chuhuyiv, worth over USD 60 million. The leadership of Eximagrokom has appealed to the prosecutor's office demanding that it press criminal charges against the bank's management and the fake co-signor –Modern Business LLC – for fraudulent conspiracy with the purpose of taking possession of the property. In December, 2014 Eximagrokom LLC completed the construction of its oil-extraction plant in Chuhuiv, Kharkiv region. The plant’s processing capacity is 1, 200 tons of sunflower seeds per day. The annual production capacity is 432, 000 tons. The plant is equipped with the world leading technologies and employs over 300 people.
