Karpatskiy Dim, CJSC does not pay to its contractors for construction of Chale Graal Complex in Truskavets
Kiev. December 24. Karpatskiy Dim, CJSC (Truskavets, Lviv Oblast) refuses to pay to its contractors for construction and equipment of Chale Graal Health and Recreation Resort Complex, as it was stated by the managers of the companies involved in the object. Miron Kulchitskiy, General Director of Comfort-Service Company, reported that Karpatskiy Dim, CJSC uses all possible means to avoid payment for the work of contractors, which had been rendering construction services for several years. "In March 2009, Karpatskiy Dim Company put into operation Chale Graal Complex, although it had still not paid us for installation of ventilation systems. Comfort-Service Company had been working on this object for three years; the customer had no claims to our work that is evidenced by the signed Acts of Acceptance. However, Karpatskiy Dim unilaterally initiated termination of the agreement refusing from paying for the services rendered," - he said. Other contractors, which had been working on Chale Graal Complex, including Medgarant, also claim the same unfair acts of Karpatskiy Dim, CJSC. "We delivered medical and cosmetological equipment in amount of UAH 1.6 m., including bonuses and maximum possible discounts, for Chale Graal Health and Recreation Resort Complex," told the Director of Medgarant Company, Aleksandr Ostrovskiy. "Although, Karpatskiy Dim Company, represented by the founder, Tatyana Ponomarenko, has been refusing to pay its debt equivalent to 52 kEUR for the delivered equipment for almost a year, explaining that SPA services are slow of sale. According to the signed acts and invoices, there were no claims or complaints regarding quality or quantity of the delivered goods. Despite the abovementioned facts, our company continues rendering guarantee and service maintenance in the frameworks of concluded agreement." In M. Kulchitskiy’s opinion, Karpatskiy Dim Company may fail to fulfill its contractual liabilities to the contractors by the reason of its financial inability in the circumstances of progressing crisis processes in Ukrainian economy. Lawyers of Adler and Partners Attorney Bureau, representing Comfort-Service Company, declare that Karpatskiy Dim Company uses imperfection of Ukrainian legislation and tries in every way to delay legal proceedings for recovery of considerable amount of debts from the company. "This may evidence on the fact that the company is insolvent and needs additional time to strip assets," pointed out the lawyer of attorney bureau, Artem Tuligolovets. Comfort-Service and Medgarant are appealing to their colleagues to pay more attention to the issue of cooperation with Karpatskiy Dim Company for them not to appear in the similar situation.
