Private enforcer to enter market within one month – deputy justice minister

KYIV. June 29 (Interfax-Ukraine) – Private enforcers could start operating and enter the market within one month, Deputy Justice Minister Serhiy Shkliar has said.

"In the near term we will issue the certificates to them. Then we should see that they insured their responsibility and they have offices and they meet the requirements set by the Justice Ministry. Then we will place information about them to the register of private enforcers and they could start working. This will happen in the near future, I think in a couple of weeks or a month," he said at a press conference at Interfax-Ukraine.

Shkliar said that at present 630 private enforcers have graduated.

The next flow of students will start training this autumn.

He said that the Justice Ministry had expected that demand on this profession would be higher.

Shkliar believes that the Association of Private Enforcers foreseen in Ukrainian law would be created by the end of this year or early 2018.

"The law says that the association of private enforcers with mandatory membership will be created. It will gradually take qualification, disciplinary and some other functions from the Justice Ministry. We would not delay the creation of the association. We will start this year, maybe, we will finish this year or early next year," he said.

Shkliar also expressed confidence that all private enforcers can start advertising their services and would have work, as at present the public enforcement service is overloaded with work.

"I think many applicants would be interested in coming to private enforcers. I think that first of all these will be banks and large private companies," he said.

The deputy minister said that currently there are no delays with paying remuneration to public enforcers.

"The remuneration is paid on time. When the reform only started the payments were delayed, as there were difficulties with the register. Now everything has stabilized. The remuneration is paid in the reasonable time – a week or two," he said.
