Ukraine should settle grain and elevator certification, operation of guarantee fund for warehouse documents for grain
Kyiv, July 17 (Interfax-Ukraine) – Ukraine should soon settle all problems with the certification of grain and services for its storage, as well as the operation of the guarantee fund for fulfilling liabilities on warehouse documents for grain, taking into account remarks of grain market players.
Head of the Practice of Law and International Trade of the Volkov and Partners law firm Andriy Zablotsky gave this opinion at a press conference at Interfax-Ukraine on Tuesday.
"Despite the fact that as a whole Ukrainian law is moving in the right direction, we believe that two issues – the quality certificate and the guarantee fund – have to be approved in the near term," he said, commenting on the draft laws regulating the said issues.
Zablotsky said that draft law No. 2459 submitted by lawmakers on amendments to the law on grain and the grain market regarding the deregulation of the grain market is the best option today.
Draft law No. 2361a initiated by the government, foreseeing the necessity to carry out a test for genetically modified organisms (GMO), will leave instruments for controlling exports by the government.
"Today, the GMO issue is regulated in Ukraine in a complicated manner. No GMO was registered. This is evidence of the fact that if lawmakers are trying to stipulate the necessity to receive a GMO certificate for each batch of goods, they will receive the ability to control exports. We don't believe that this is appropriate today, as there are no registered GMOs in the country," he said.
Commenting on the initiatives on the creation of the guarantee fund for fulfilling liabilities under warehouse documents for grain, he said that "Ukraine turned it on its head."
"Today, there are some open questions on the operation of grain warehouses, which are obliged to enter the guarantee fund. In our opinion, this is incorrect, as it creates the possibility for warehouses to be influenced by the fund if the current law base is not changed. We'd like for the remarks of the market players to be accepted, as taking into account the potentially large forecasts for exports, the operation of warehouses could stop at certain moment," he said.
