ASNU draws up own bill on realtors' operations

Kyiv, April 17 (Interfax-Ukraine) - The Association of Realtors of Ukraine (ASNU) has drawn up its own bill regulating realtors' operations, ASNU President Serhiy Zlyden has said.

"At present, the bill is in the ownership of the association and today we inform consumers and the whole realtor society that the product is more balanced, it does not lobby for the interests of any realtors' groups and any investors," he said at a press conference at Interfax-Ukraine on Tuesday.

Zlyden said that ASNU specialists, realtors and other market players took part in the drawing up of the bill in 2012.

He said that at present, the bill has not yet been registered in the Ukrainian parliament, and no other bills regulating professional option of realtors in Ukraine are registered.

Head of the Law Committee at the ASNU, Yuriy Pita, said that the bill is based on market principles, and in particular, it does not foresee the setting of a tariff for services provided by realtors, which amounts to 3% of the cost of the deal, and includes other restrictions that hinder the development of market relations.

Pita added that today the bill has not been published, as it has not yet been finalized.

As reported, in July 2012, the Economic Development and Trade Ministry of Ukraine again proposed to regulate the realtor business, empowering the ministry with the right to issue certificates to realtors and keep the state realtors register, while in the previous draft law the functions were assigned to the State Property Fund of Ukraine (SPF). The new draft law on the specifics of doing realtor business was drawn up under an order of Ukrainian President Viktor Yanukovych.

In June 2007 the Ukrainian parliament did not support draft law No. 3499 on realtors' operations, the major goal of which was to legislatively regulate realtors' activity on Ukraine's real estate market. The bill was authored by Ihor Prasolov.

On July 7, 2011, Prasolov registered draft law No. 8781 on realtors' operations, which was mainly focused on the protection of the rights of realty service consumers.

Ukrainian President Viktor Yanukovych in November 2011 ordered Ukrainian Premier Mykola Azarov by January 30, 2012 to submit to parliament a draft law on realtors' operations. The Economic Development and Trade Ministry drew up a draft law on specifics of doing realtors' operations, which has not been registered in parliament. However, several nongovernmental organizations of realtors addressed the leadership of the country to take the Prasolov's bill on realtors' operation as a basis.

The Association of Realtors of Ukraine was established in 1995. It unites representatives from 25 regions of Ukraine in 32 cities and towns.
