Public members report on illegal building of Velyka Kishenya supermarket in Darnytsky district in Kyiv
Kyiv, April 1 (Interfax-Ukraine) – The construction of a trade outlet for a Velyka Kishenya supermarket opened on March 23 at 10 Vyshniakivska Street in Darnytsky district in Kyiv was carried out without permits, state agencies ignore court rulings regarding this commercial facility, and it is being operated illegally, representatives of public organizations and an initiative group of residents of nearby buildings said at a press conference at Interfax-Ukraine in Kyiv on Monday.
"In fact, at present there is no document that would enable anyone to use this land - the land belongs to the community," said the lawyer of the initiative group members, Ihor Ivanov.
According to him, the residents, in the person of their lawyer, appealed to the Kyiv Administrative Court of Appeals, which by its ruling of October 4, 2012 declared illegal the decision of Kyiv City Council under No. 779/3354 of July 14, 2005 on leasing the land plots to individual entrepreneur Heorhiy Kovalenko for 15 years for the construction and operation of retail and office complexes and catering on an area of 0.24 hectares at 8-12 Vyshniakivska Street.
The Higher Administrative Court of Ukraine upheld the above-mentioned ruling of the Court of Appeals and on March 13, 2013 rejected the appeal by Kovalenko.
