Constitutional Court will rule on legitimacy of raising gas tariffs for public – NCER
The validity of raising gas tariffs for the public in spring 2015 will be judged by the Constitutional Court, Head of the National Commission for Energy, Housing and Utilities Services Regulation (NCER) Dmytro Vovk has told reporters.
"The Kyiv District Court of Appeals made a ruling on the appeal to the Constitutional Court and stopped proceedings [under the NCER appeal]," he said.
The Kyiv District Court of Appeals made the relevant decision at a meeting on November 18.
As reported, the court of first instance ruled that raising gas tariffs for the public by an NCER decision in March 2015 was unlawful.
The court based its decision on the fact that the NCER decree was signed by Dmytro Vovk who was acting head of the commission, although this position is not stipulated in law.
