Court confirms Austrian Megainpharm's right to ocular antiseptic in dispute with Darnytsia pharmacy
The Higher Economic Court of Ukraine has confirmed the decision of the Kyiv Economic Court of Appeal, dated February 27, which restored the patent of Austria's Megainpharm to ocular antiseptic and invalidated the state registration of this medicine by Darnytsia pharmaceutical company.
The corresponding court decision, dated April 21, 2015, is available in the state court rulings register.
The reason for the dispute was Darnytsia's right to manufacture Oftamirin eye drops, which, according to the plaintiff, are an unauthorized copy of the original Okomistyn medicine of Megainpharm GmbH, which is produced by Farmak pharmaceutical company.
Both drugs are made on the basis of myramistinum antiseptic, the patent for which is owned by Megainpharm GmbH and in accordance with which the original Okomistyn medicine is manufactured.
