AIS beneficiaries continue manipulating with debts, collateral to avoid meeting commitments to creditors – DCH

The DCH Group of businessman Oleksandr Yaroslavsky has announced its official position about the situation with the debt of the AIS Corporation under a $50 million loan issued by UkrSibbank in 2007. The claims to the debts were assigned by the bank to DCH in 2017.

According to a statement of the DCH press service on its website on Monday, the need for an official statement is dictated by "the fact of deliberate spreading of inaccurate information about the role of DCH in the situation with the repayment of debts of AIS enterprises to UkrSibbank."

According to the statement, DCH had earlier assisted the international financial group BNP Paribas on the issue of recovering the troubled debt of the AIS group, and in 2017, UkrSibbank assigned the rights to claim these debts to DCH.

"Throughout 2009-2017 between UkrSibbank, Dmytro Sviatash and Vasyl Poliakov [the latter are co-founders of the AIS Group, act as guarantors and joint debtors in the loan], including with the participation of DCH, negotiations on restructuring debts were permanently held. The parties agreed at various stages of the negotiation process on settlement options: at the initial stage - restructuring, at later stages - the repayment of debts of AIS with a discount. Documented agreements were also reached, but each time under one or another pretext the debtors refused to fulfill their obligations to the bank," DCH said in a statement.

In 2010, AIS made the first sale of immovable property transferred to the UkrSibbank mortgage, removing the prohibitions on alienation of mortgage facilities on the basis of a counterfeit decision of the Voroshilovsky district court of Donetsk.

"In the future, this property was several times resold, divided between several legal entities, and these companies operate further division/fragmentation of mortgage facilities in order to change the registration numbers of the facilities and addresses," DCH said, describing the situation in the statement.

At present, according to DCH, all illegally withdrawn real estate facilities belong to legal entities, whose ultimate beneficiaries are direct relatives of Sviatash: his parents are Larisa Sviatash and Volodymyr Sviatash.

"And all the debts of the AIS Group to other creditor banks (Swedbank and VTB) were bought by legal entities, the ultimate beneficiary of which is a direct relative of Vasyl Poliakov - his sister Iryna Poliakova," DCH said.

"DCH is a conscientious acquirer of the debt pool of the enterprises belonging to the AIC Group and Sviatash. The issue of fair judicial decisions to collect debts of the AIS Corporation enterprises, in our opinion, will help improve the investment image of Ukraine in the eyes of investors," DCH said.
