Kyiv court postpones until Feb 2019 case on cancellation of 2009 contracts with Gazprom on RUE gas

The Kyiv Economic Court of Appeals has postponed until February 19, 2019 consideration of the appeal of the Prosecutor General's Office, which seeks to invalidate the contracts of January 20, 2009 for the purchase by Gazprom from Naftogaz Ukrainy of 11 billion cubic meters of gas belonging to RosUkrEnergo (RUE, Switzerland) for $1.7 billion.

According to the materials of the case posted in the court rulings system, the Prosecutor General's Office appealed promptly against the decision of the Kyiv Economic Court of July 23, 2015, but its consideration was repeatedly postponed.

The next petition to postpone consideration of the case on June 11, 2018 was made by Naftogaz Ukrainy due to the fact that the decision of the Stockholm Arbitration in the dispute with Gazprom was appealed by the latter, thus preserving the "factual circumstances that served as the basis for the previous adjournment of the case."

The Economic Court of Appeals also obliged Naftogaz and Gazprom to provide normatively substantiated written explanations on the grounds for the conclusion on the contested gas purchase and sale agreements in January 2009.

As reported, in early 2009 Naftogaz Ukrainy won the rights to RosUkrEnergo worth $1.7 billion from Gazprom in exchange for gas supplied to the trader by the Russian company, unilaterally taking 11 billion cubic meters of gas held in Ukrainian storage facilities. This was the reason why RUE filed a claim with the Arbitration Institute of the Stockholm Chamber of Commerce.
