Kyiv district court restricts Rozhkova's powers as NBU deputy head

Kyiv's Darnytsky District Court by the ruling dated December 26, 2017 satisfied the lawsuit of MP Ihor Lutsenko to restrict the powers of Yekateryna Rozhkova as the deputy chairman of the National Bank of Ukraine (NBU).

The corresponding decision was promulgated in the Unified Court Rulings Register on March 30, 2018.

"To prohibit Rozhkova from taking part in the work and meetings of the NBU board, as well as performing any actions related to the execution of powers of the NBU deputy head and/or any other activities as the deputy head of the NBU until the dispute is essentially resolved," the document reads.

According to the report, the ruling comes into force immediately after the date of issuance, on December 26, 2017, and is subject to immediate implementation. At the same time, the appeal of the decision does not stop its execution.

At the same time, the NBU claims until now it has not received the text of the resolution limiting the powers of Rozhkova from Darnytsky District Court and thus has no grounds for taking any appropriate measures.

"According to Part 2 of Article 157 of the Civil Procedure Code, the cautionary judgment cannot be executed until the court, which issued the relevant ruling, notifies the persons whom the ruling concerns. Thus, the NBU will consider the implementation of the decision after it is received from the court," the press service of the central bank said.

In general, the National Bank considers the above mentioned decision to be illegal, adopted in violation of a number of legislative acts and creating a dangerous case for blocking the work of public authorities.
